1. Acceptance of Terms
These Terms of Service ('Terms') govern your access to and use of ALF Smart Deal (the 'Service'), a software-as-a-service platform operated by Assisted Living Launchpad ('we,' 'us,' or 'our'). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@alfsmartdeal.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
4. Subscription Plans & Billing
The Service is offered on a monthly subscription basis. Current plans and pricing are listed on our Pricing page. By subscribing, you authorize us (through our payment processor) to charge the applicable fee to your payment method on a recurring monthly basis until you cancel.
- Subscriptions auto-renew each billing cycle unless cancelled.
- You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing cycle.
- Fees are generally non-refundable, except where required by law.
- Unused monthly assessments do not roll over.
- We may change pricing with at least 30 days' notice; changes apply to your next billing cycle.
5. Acceptable Use
You agree not to:
- Use the Service to violate any applicable law or regulation.
- Resell, sublicense, or commercially redistribute Service output without our written consent.
- Scrape, reverse-engineer, or attempt to derive the source code of the Service.
- Upload malicious code, attempt to disrupt the Service, or bypass usage limits.
- Use the Service to infringe intellectual property rights or harass others.
6. Intellectual Property
The Service, including its software, scoring engine, database, design, and all related content, is owned by Assisted Living Launchpad and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your internal business purposes in accordance with these Terms. You retain ownership of data and content you submit ('User Content'), and grant us a license to use User Content to provide and improve the Service.
7. Third-Party Data
The Service integrates data from third-party sources including Google Maps, FEMA Flood Map Service Center, US Census Bureau, ATTOM Data Solutions, and Anthropic. Third-party data is provided as-is, and we do not guarantee its accuracy or availability. Your use of the Service is also subject to the terms of these third-party providers where applicable.
8. AI-Generated Content
Certain features of the Service generate content using artificial intelligence (the AI Report is powered by Anthropic's Claude Opus 4 language model). AI-generated content is provided for informational purposes only, may contain errors or omissions, and should be independently verified before being relied upon for any investment, operational, or legal decision.
9. No Investment, Legal, or Professional Advice
ALF Smart Deal is a decision-support tool. It does not provide investment advice, legal advice, tax advice, real estate brokerage services, or licensing determinations. The composite score, verdict, financial model, AI Report, and other outputs are informational and do not constitute a recommendation to buy, sell, finance, or operate any property. Always consult licensed professionals before making any investment, legal, or regulatory decision.
10. Disclaimers
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that data produced by the Service will be accurate, current, or complete.
11. Limitation of Liability
To the maximum extent permitted by law, Assisted Living Launchpad, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
12. Indemnification
You agree to defend, indemnify, and hold harmless Assisted Living Launchpad from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
13. Termination
You may terminate your account at any time by cancelling your subscription and contacting support. We may suspend or terminate your access at any time for violation of these Terms, non-payment, or any other reason with reasonable notice. Upon termination, your right to use the Service ceases; certain provisions of these Terms survive termination, including Sections 6, 10, 11, 12, and 15.
14. Modifications
We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Maryland, and you consent to the exclusive jurisdiction of those courts.
